What is shadow AI, and why does it matter?

Shadow AI is the use of AI tools at work without the company’s knowledge or approval — for example, pasting a client contract into a free chatbot from a personal account.

The risk isn’t that AI is bad; it’s that confidential information leaves your control. Free consumer tools may keep or use data under terms your business never agreed to, and you can’t revoke a former employee’s personal account.

For many South Florida businesses this is also a compliance issue. Healthcare practices have HIPAA obligations; tax preparers, mortgage brokers and other non-bank financial businesses fall under the FTC Safeguards Rule; SEC-registered advisers and broker-dealers must meet amended Regulation S-P requirements (smaller entities by June 3, 2026); and Florida lawyers must protect client confidentiality under Florida Bar Ethics Opinion 24-1.
